7. Consumer Health Data Privacy Notice
This section applies to information that qualifies as “consumer health data” under applicable law, including Nevada Revised Statutes Chapter 603A.

7.1 Categories of consumer health data we may collect
We may collect consumer health data relating to physical or mental health status, fitness and activity, nutrition and eating habits, weight and body measurements, injuries, symptoms, medical conditions, medications, health history, bodily functions, wellness goals, progress, behavioral or lifestyle interventions, and inferences made from this information. Photos, videos, voice recordings, or other identifying information may also constitute consumer health data when used in connection with health or fitness information.
We do not intentionally collect genetic data or precise geolocation for the purpose of identifying a person’s attempt to obtain health-related services unless we clearly disclose that collection and obtain any consent required by law.

7.2 Sources of consumer health data
We collect consumer health data primarily from you through forms, applications, questionnaires, surveys, workbooks, messages, calls, progress updates, photos, videos, and your participation in our products or services. We may also receive it from team members, coaches, contractors, service providers, or third parties at your direction or where necessary to provide a service you requested.

7.3 How consumer health data is used and processed
We may access, organize, review, store, analyze, communicate, or otherwise process consumer health data to:
  • provide and personalize the product or service you requested;
  • understand your goals, limitations, progress, and support needs;
  • communicate with you and provide coaching or educational feedback;
  • maintain records, administer programs, and improve our services;
  • protect users, prevent misuse, and comply with law; and
  • use a testimonial, progress story, or “before and after” material when you have separately authorized that use.
7.4 Categories of consumer health data we may share
We may share the categories of consumer health data described in Section 7.1 only as reasonably necessary to provide a service you requested, as directed by you, with your affirmative consent where required, or as otherwise permitted or required by law.

7.5 Categories of recipients
Consumer health data may be shared with:
  • authorized employees, coaches, assistants, and contractors who need access to provide or support the requested service;
  • service providers that support secure hosting, data storage, forms, communications, customer management, program delivery, video calls, or other business operations;
  • professional advisors, insurers, auditors, or legal authorities where necessary or required by law; and
  • a successor entity in connection with a merger, acquisition, financing, reorganization, bankruptcy, or transfer of business assets, subject to applicable law.
Access is limited to what is reasonably necessary for the relevant purpose. We do not sell consumer health data.

7.6 Advertising and cross-site tracking
Analytics and advertising providers may use cookies, pixels, or similar technologies to collect device identifiers, browsing activity, and interactions with the Site over time and across websites or online services.
We do not intentionally provide health questionnaire responses, medical information, progress photos, or other consumer health data to advertising networks for targeted advertising. Consumer health data will not be used or shared for a materially different purpose without any notice and affirmative consent required by law.

7.7 Consent and withdrawal
Where required, we will obtain affirmative consent before collecting consumer health data and separate consent before sharing it. You may withdraw consent and ask us to stop collecting or sharing your consumer health data by emailing team@elevatewithkatriona.com. Withdrawal does not affect processing that occurred lawfully before withdrawal and may affect our ability to continue providing a service that requires the information.

7.8 Consumer health data requests
You may ask us to:
  • confirm whether we collect, share, or sell consumer health data about you;
  • provide a list of third parties with whom your consumer health data has been shared or sold;
  • review or correct your consumer health data;
  • stop collecting or sharing your consumer health data; or
  • delete your consumer health data.

If we deny your request, you may appeal by emailing the same address with the subject line “Privacy Appeal.” We will review the appeal and respond within the period required by applicable law. If a Nevada consumer’s appeal is denied, the consumer may contact the Nevada Attorney General at https://ag.nv.gov.

8. Cookies and Similar Technologies
We and third parties may use cookies, pixels, tags, local storage, and similar technologies for the following purposes:
  • Essential: to operate, secure, and provide core Site functions;
  • Functional: to remember settings and improve functionality;
  • Analytics: to measure traffic, performance, and use of the Site; and
  • Advertising: to measure campaigns, build audiences, limit repeated advertisements, and deliver or evaluate personalized advertising.
Where required by law, we will request consent before using non-essential cookies or similar technologies. You may manage cookies through any consent tool made available on the Site and through your browser or device settings. Blocking certain cookies may affect Site functionality.
Some browsers and devices offer privacy signals, including Global Privacy Control. Where legally required, we will treat a recognized signal as a request to opt out of applicable sale, sharing, or targeted advertising for that browser or device.

9. Marketing Communications
We may send marketing communications where you have consented or where otherwise permitted by law. You may unsubscribe at any time by using the unsubscribe link in an email or contacting us at team@elevatewithkatriona.com.
Even if you opt out of marketing, we may continue to send transactional or service-related communications, such as account, purchase, program, security, or legal notices.

  • employees, team members, coaches, assistants, and contractors;
  • vendors and service providers supporting hosting, payments, program delivery, communications, forms, customer management, analytics, advertising, security, and business administration;
  • accountants, lawyers, auditors, insurers, and other professional advisors;

  • parties involved in a merger, acquisition, financing, reorganization, bankruptcy, or transfer of all or part of our business; and
  • other parties at your direction or with your consent.
We do not sell personal information or consumer health data for money. However, some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include certain disclosures of online identifiers to advertising or analytics providers. Where such laws apply, you may request to opt out by emailing team@elevatewithkatriona.com or using any privacy controls made available on the Site.

11. International Data Transfers
BBK COACHING LLC is based in the United States. Your personal information may be processed in the United States and in other countries where our team members, contractors, or service providers operate. Those countries may have different data protection laws than your country of residence.
Where required by applicable law, we use recognized safeguards for international transfers, which may include contractual protections, approved standard contractual clauses, adequacy mechanisms, or other legally permitted safeguards.

12. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, maintaining business and transaction records, complying with tax, accounting, contractual, and legal obligations, resolving disputes, and enforcing agreements.
Retention periods vary depending on the nature and sensitivity of the information, the purpose for which it was collected, the duration of our relationship with you, legal requirements, and security considerations. When information is no longer required, we will delete it, anonymize it, or securely isolate it until deletion is possible, subject to applicable law and legitimate backup or archival requirements.

13. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. We limit access to sensitive and consumer health data to people and service providers who reasonably need it for authorized purposes.
No method of transmission or storage is completely secure. Therefore, we cannot guarantee absolute security.
